Federal Laws Every Agent Must Know

Fair Housing Act (1968): Prohibits discrimination in housing based on 7 protected classes. Expanded over time.


RESPA (Real Estate Settlement Procedures Act): Requires disclosure of all settlement costs. Prohibits kickbacks between settlement service providers. Mandates Loan Estimate and Closing Disclosure (now under TRID).


TILA (Truth in Lending Act): Requires disclosure of APR and loan terms. Gives borrowers 3-day right of rescission on refinances.


TRID (TILA-RESPA Integrated Disclosure): Combined TILA and RESPA disclosures into Loan Estimate (within 3 days of application) and Closing Disclosure (3 days before closing).


Equal Credit Opportunity Act (ECOA): Prohibits discrimination in lending based on race, color, religion, national origin, sex, marital status, age, or public assistance income.


Americans with Disabilities Act (ADA): Commercial buildings and public accommodations must provide reasonable access for people with disabilities.


Do Not Call Registry: Agents cannot call numbers on the national registry without prior consent.
